Honor Code

In addition to the behaviors outlined by the official competition rules, "cheating" encompasses any attempt to gain an edge in accuracy by using information that is outside of the provided datasets, or an attempt to use the provided information in a way that is not intended. Examples of cheating include (but are not limited to):

  • Attempting to use datasets and references beyond those made available by the competition
  • Attempting to abuse the competition infrastructure to gain an edge

Please note that Competition Host reserves the right, but does not have the obligation, to review submitted code to disqualify any contributions demonstrating cheating, and the right to determine what it believes, in its sole discretion, constitutes cheating. We respectfully request that you refrain from cheating.

While Competition Host reserves the right to take effective measures to detect and disqualify cheating, we ask that you personally abide by codes of honor and ethical behavior in your participation.

TEAMS

FORMING A TEAM

Multiple individuals or entities may collaborate as a team (“Team”). You may not participate on more than one Team. Each Team member must be a single individual operating a separate cloud data platform. You must register individually for the Competition and enter your team name upon registration.

Team membership may not exceed the Maximum Team Size (up to but not to exceed 3 people). Each team member must have an active user and have verifiable credentials from the Competition Host.

Entries (individuals or teams) will be selected on a first-in-first-served basis to join this exciting initiative although there will be a maximum of two entries (individuals and/or teams) from any one organization.  A maximum of 60 individuals may participate in the Competition, whether as part of a team or as an individual competitor.  Notwithstanding the foregoing, S&P reserves the right to increase or decrease the maximum total number of entries accepted and/or establish a cap on the total number of individuals who participate in the Competition whether as part of a team or as an individual competitor.

TEAM MERGERS

Teams are not permitted to merge.

Submission Limits

You, or your team, may only submit one final submission for judging.


COMPETITION FRAMEWORK

These are the complete, official rules for the Competition (the 'Competition Rules') and incorporate by reference the contents of the Competition Website listed above.

By accepting these rules below you are agreeing to be bound by these Competition Rules which constitute a binding agreement between you and the Competition Host.

The Competition will run from Start Date to End Date as listed on the Competition Website. Note that Competition deadlines are subject to change. Any additional or altered deadlines not already described in these Competition Rules will be publicized to the Participants via the Competition Website. It is the Participant's responsibility in this Competition to check the Competition Website regularly throughout the Competition to stay informed of any new or updated deadlines. Competition Host is not responsible for any Participant's failure to do so.

Each registered individual or member of a Team is referred to as a Participant ('Participant'). You may only participate using a single, unique work email address. Participating using more than one email address per individual Participant is a breach of these Competition Rules and Competition Host reserves the right to disqualify any Participant (or Team including Participant) who is found to breach these Competition Rules.

Participant acknowledges and agrees that the Competition Host and its affiliates may collect, store, share and otherwise use personally identifiable information provided during the registration process and the Competition, including, but not limited to, name, mailing address, phone number, and email address. The Competition Host will use this information in accordance with its Privacy Policy (https://www.spglobal.com/en/privacy/privacy-policy-english), including for administering the Competition and verifying Participant’s identity, postal address and telephone number in the event an entry qualifies for a reward. Participant’s information may also be transferred to countries outside the country of participant’s residence, including the United States. Such other countries may not have privacy laws and regulations similar to those of the country of participant’s residence.

If a participant does not provide the mandatory data required at registration, or requests that such be deleted prior to completion of the Competition and payment of any prize monies, the Competition Host reserves the right to disqualify the entry.

Participant has the right to request access, review, rectification or deletion of any personal data held by the Competition Host in connection with the Competition by writing to the Competition Host at this email address: [email protected].

Every Participant consents to (1) S&P Global disclosing Participant information, i.e., email address, company name, to Competition Host and its Affiliates, including personally identifiable information contained therein; and (2) Competition Host contacting the Participant. Notwithstanding the foregoing, Competition Host has no obligation to request or review the foregoing information and no obligation to contact any Participant except as otherwise required herein.  By participating in the Competition, you acknowledge that your photographic image such as photographs, screen shots, videos and media recordings (“Photos”) may be taken by the Competition Host during the course of the competition and that the Competition Host may use such Photos for advertising, marketing, public relations and similar purposes.  You acknowledge that your Photos may be transferred, processed, disclosed and stored outside of the country jurisdiction in which the Photos were taken or collected.  You may request access to your Photos or that S&P Global stop processing your Photos in future at any time by contacting us at [email protected]. Depending on how the Photos have been used, it may not be practicable to delete or remove the Photos in all cases. For example, where a publication is already in circulation.

ELIGIBILITY

The Competition is open to any individual over the age of 18 who is employed by an entity formed under Australian or New Zealand law (including academic institutions, registered partnerships, and limited liability entities) at the time of entry, provided that such individual that such individual is an Australian or New Zealand resident and has not declared or been declared in bankruptcy as of the date of Competition registration.  Any individual who meets the definition of “government official” as defined below agrees to forfeit their prize and acknowledges that they will not receive any cash or cash equivalent prize. For purposes of the foregoing,

  • “Government official” means:
    • any public or elected official;
    • any officer, employee (regardless of rank), or person acting on behalf of a national, provincial, or local government, including
      • a department, agency, or instrumentality,
      • a state-owned or state-controlled enterprise (State-Owned Entity or SOE) such as real estate development firms, investment funds, hospitals, universities, commercial enterprises or sovereign wealth funds;
      • any officer, employee (regardless of rank), or person acting on behalf of a Public International Organization (such as the United Nations or World Bank);
      • a political party, party official or any candidate for political office; or
      • any officer, employee (regardless of rank), or person acting on behalf of an entity that is financed in large measure through public appropriations, is widely perceived to be performing government functions, provides services to all inhabitants of a jurisdiction or has its key officers and directors appointed by a government.
Exclusions: Employees of S&P Global or their relatives, foreign government officials (including senior foreign political figures, close associates and immediate family members of government officials) are not eligible to participate in the contest.  For purposes of the foregoing,

  • “Foreign government official” means:
    • any officer or employee of a foreign government or any department, agency, or instrumentality thereof, or of a public international organization, or any person acting in an official capacity for or on behalf of any such government or department, agency, or instrumentality, or for or on behalf of any such public international organization.
  • “Senior foreign political figure” is a senior official in the executive, legislative, administrative, military or judicial branches of a foreign government (whether elected or not), a senior official of a major foreign political party, or a senior executive of a foreign government-owned corporation. In addition, a senior foreign political figure includes any corporation, business, or other entity that has been formed by, or for the benefit of, a senior foreign political figure.
  • Immediate family member of a senior foreign political figure typically includes the figure’s parents, siblings, spouse, children, and in-laws.
  • Close associate of a senior foreign political figure is a person who is widely and publicly known to maintain an unusually close relationship with the senior foreign political figure, and includes a person who is in a position to conduct substantial domestic and international financial transactions on behalf of the senior foreign political figure.
Officers, directors, employees and advisory board members (and their immediate families and members of the same household) of the Competition Host, their respective affiliates, subsidiaries, interns, contractors, agents, judges of the Competition, sponsors of the Competition and related events (including the Portfolio Construction Forum (PCF), Chartered Institute of Management Accountants (CIMA) and CFA Institute and advertising and promotion agencies involved with the Competition are not eligible to participate in the Competition.

SUBMISSIONS

'Submission' means the material created and submitted by you in the manner and format specified on the Website via the email address provided on the Website. In this Competition, the Submission will be in the form of code, any supporting data analysis or evidence of constructed portfolios, data visualization and a write up, to be produced in one Notebook with the S&P Global Workbench platform. The submission will be an URL for the Notebook. This is a skills-based competition, and all submissions must be original code created by you. You (or if you are part of a Team, your Team) may submit only one entry as specified above. Submissions must be received prior to the Competition deadline and adhere to the guidelines for Submissions specified on the Website.

“Non-Permitted Data”: Submissions may not use or incorporate information or data other than that made available by S&P Global for purposes of this Competition. Submissions may not use or incorporate information from hand labeling or human prediction of the validation dataset or test data records. Submissions may not make reference to forward-looking data sources (i.e., any data sources that look ahead in time past the data provided) or make use of external or other non-permitted data. Submissions may not include any material, non-public information.

INTELLECTUAL PROPERTY

DATA

'Data' means the data, datasets or other information provided by S&P Global via S&P Global Market Intelligence Workbench and/or the Platts Dimensions Pro website for the purpose of use by Participants in the Competition. For the avoidance of doubt, the term “Data” as used in these Competition Rules includes, but is not limited to, any whitepapers, models, prototypes, S&P Global prepared notebooks and/or executable code provided to Participants by Competition Host. Participants must use the Data only as permitted by these Competition Rules and any associated data use rules specified on the Competition Website.

EXTERNAL DATA

Unless otherwise expressly stated on the Competition Website, Participants must not use data other than the Data to develop and test their models and Submissions. Competition Host reserves the right in its sole discretion to disqualify any Participant who Competition Host determines in its sole discretion has undertaken or attempted to undertake the use of data other than the Data, or who uses the Data other than as permitted according to the Competition Website and in these Competition Rules, in the course of the Competition.

CODE SHARING

Participants are prohibited from privately or publicly sharing code, analysis, visualizations, the Workbench Notebook and any other output developed in connection with or based upon the Data with other individuals, and any such sharing is a breach of these Competition Rules and may result in disqualification.

Limitations and Restrictions on Use: Unless otherwise permitted by the terms of the Competition Website, Participants must use the Data solely for the purpose and duration of the Competition, including but not limited to reading and learning from the Data, analyzing the Data, modifying the Data and generally creating your Submission and any underlying models and participating in forum discussions (virtual or in person) hosted by the Competition Host or otherwise approved by the Competition Host as evidence in communications from the Competition Host. Participants must not copy, access, store, archive, or otherwise use the Data for any purpose other than to participate in the Competition for which such Data was provided. Participants may not use the data in such a way as to repackage, resell, allow bulk data download, or otherwise similarly exploit the data for internal or commercial business purposes. Participants agree to use commercially reasonable measures to prevent persons who have not formally agreed to these Competition Rules from gaining access to the Data and agree not to transmit, duplicate, publish, redistribute or otherwise provide or make available the Data to any party not participating in the Competition. Participants agree to notify Competition Host immediately upon learning of any possible unauthorized transmission or unauthorized access of the Data and agree to work with Competition Host to rectify any unauthorized transmission. Participants agree that participation in the Competition shall not be construed as having or being granted a license (expressly, by implication, estoppel, or otherwise) under, or any right of ownership in, any of the Data.


Breach of these Competition Terms & Conditions shall cause S&P Global, its affiliates, and/or their third-party data providers irreparable injury that cannot be adequately compensated for by means of monetary damages.  S&P, its affiliates and/or such third-party data providers may enforce the provisions hereof by means of equitable relief (including injunctive relief) in addition to any other rights and remedies that may be available.

Participant may access the Data using the platforms and methods delineated by the Competition Host, and only in accordance with the limitations and restrictions set forth in these Terms & Conditions. Participant shall hold any passwords/user IDs issued by to it in connection with the Competition in strict confidence and shall not share its user ID or password with any third party, including but not limited to, any other Participant The Competition Host shall not be liable or otherwise responsible for any of the following: (i) the procurement, installation or maintenance of any equipment on which the Data is accessed by the Participant; (ii) any communications connection by which the Data is transmitted; (iii) any communication delays or interruptions of the Data; (iv) the transmission to the Participant of the Data; or (v) any fees payable by the Participant for any communication lines, to any third-party network operator (a "Network Operator") or to any other person, firm or entity.

Participants acknowledges and agrees that (1) it may only use the Workbench platform (a Databricks Inc. environment), in connection with the Competition, and for no other purpose; (2) should S&P’s agreement with Databricks terminate, Participant shall no longer have access to Workbench; (3) S&P Global and not Participant is Databrick’s “customer” with respect to Participant’s use of Workbench and accordingly, Databricks has no obligations to Participant related to the use of Workbench; (4) S&P Global will have access to any and all content made available on Workbench by Participant.  .  Participant agrees that, in its use of the Workbench platform, it will not include any information which is related to an identified or identifiable natural person or that when used alone or when combined with other personal or identifying information could be used to identify, locate, or contact an individual, such information. includes, but is not limited to, identification number(s), location data, or to one or more factors specific to an individual's physical, physiological, mental, economic, cultural, or social identity.  S&P is not responsible for any loss of data in connection with Participant’s use of the Workbench platform.

Access to the Platts information available via Platts DimensionsPro, is subject to the terms of the Platts Data Protection Appendix (“Platts DPA”) as set forth at www.platts.com/data-protection-appendix, which terms are incorporated into and made a part of these Terms & Conditions. For purposes of interpreting such Platts DPA, as it applies to this Competition, references to “Agreement” shall be construed to refer to these Terms & Conditions; references to “Subscriber” and/or “Authorized User” shall be construed to refer to you, the Participant.

Access to the S&P Global Market Intelligence data is subject to the provisions of the S&P Data Protection Appendix (“MI DPA”) as set forth on https://www.spglobal.com/marketintelligence/en/documents/Data-Protection-Appendix.pdf, which are incorporated into these Terms & Conditions and made a part hereof. For purposes of interpreting such MI DPA, as it applies to this Competition, references to “Agreement” shall be construed to refer to these Terms & Conditions; references to “Subscriber” and/or “Authorized User” shall be construed to refer to you, the Participant.


Access to S&P Dow Jones Indices data is subject to the provisions of the S&P Data Protection Appendix (“SPDJI DPA”) as set forth on https://www.spglobal.com/spdji/en/documents/legal/spdji-data-protection-appendix-subscription-sept-2021.pdf, which are incorporated into these Terms & Conditions and made a part hereof.  For purposes of interpreting such SPDJI DPA, as it applies to this Competition, references to “Agreement” shall be construed to refer to these Terms & Conditions; references to “Subscriber” and/or “Authorized User” shall be construed to refer to you, the Participant. 

EXPUNGEMENT

Promptly after the Submission Deadline, Participants must immediately cease use of the Data and expunge all the Data and any portion or copies thereof from all of Participant’s electronic systems. At S&P Global’s request, Participants shall certify to S&P Global in writing that they have fully complied with the foregoing expungement requirement.

SUBMISSION

Participant understands and agrees that its Submission shall constitute the copyrighted property of Competition Host and that no compensation for such is owed to Participant.  As between Participant and Competition Host, Competition Host shall be the sole and exclusive owner of all the rights comprised in the copyright and of all possible copyright registrations, patents, trademarks and all applications for or renewals of any of the foregoing, and of any of the other intangible intellectual property embodied in the Submission.   Participant hereby grants and assigns exclusively to Competition Host (or its designees) all rights, title and interest in the Submission throughout the world which shall include but not be limited to all copyrights (and renewals, extensions and continuations of copyright) and in all derivative works, together with all exclusive rights granted to an author under the copyright laws of the United States, Australia, foreign countries and international copyright conventions and the right to grant to such rights or any part of them to third parties; and all patents, trademarks and all possible applications for or renewals of any of the foregoing anywhere in the world; and any and all other intangible intellectual property embodied in the Submission.  Participant appoints Competition Host as its attorney in fact to execute any documents Competition Host deems necessary to record any of these grants with the United States Copyright Office, the United States Patent and Trademark Office or elsewhere around the world.  The Participant shall also execute such further instruments and take such further actions as Competition Host may request to establish, maintain or protect its rights in and ownership of the Submission.  In the event that any portion of this paragraph is found to be unenforceable, Participant agrees that by making a Submission, Participant is granting the Competition Host and its affiliates, an exclusive, royalty free, perpetual, transferable, unlimited license to display, copy, combine, compile, distribute, sublicense, create derivative works from, disseminate, and otherwise exploit, all or part of your Submission (including but not limited to any code contained therein or used to generate the Submission) without further approval by or payment to Participant.  Participant represents that they have the unrestricted right to grant the foregoing to the Competition host without the need for any licenses, releases, consents, approvals or immunities not yet obtained.

Participant may not commercialize any material in the Submission. However, Participant may utilize the Submission in connection with non-commercial, non-profit academic works or publications that have been approved in writing by S&P Global (“Permitted Publications”) provided that with respect to usage of Data, Participant may only utilize limited, non-substantial portions of the Data in such Permitted Publications.

Participant shall (a) provide appropriate credit to S&P as one of the sources relied on for the material included in the Permitted Publication; (b) provide appropriate credit to S&P where specific data and/or information from the Services is cited in the Permitted Publication and include the following copyright notice “Copyright © 201*, S&P Global Market Intelligence (and its affiliates, as applicable); and (c) include in a clear and conspicuous manner, the Disclaimer Notice set forth below (or a substantially similar notice) on behalf of S&P, its affiliates and their suppliers on the Permitted Publication, in the event specific data and/or information from the Services is cited in the Submission. Participant shall comply with S&P’s reasonable requests to update the Disclaimer Notice. Without limiting anything set forth herein, and to the extent not expressly prohibited by applicable law, Participant shall indemnify and hold harmless S&P, its affiliates and their suppliers from and against any and all costs, losses, damages, liabilities and fees (including reasonable attorney’s fees) arising out of any dissemination or use of the Data or material from the Submission in such publications that does not contain the Disclaimer Notice(s) as stated above. The foregoing indemnity shall survive indefinitely. Participant shall provide S&P with copies of the Permitted Publications upon S&P’s request. Disclaimer Notice:

“Reproduction of any information, data or material, including ratings (“Content”) in any form is prohibited except with the prior written permission of the relevant party. Such party, its affiliates and suppliers (“Content Providers”) do not guarantee the accuracy, adequacy, completeness, timeliness or availability of any Content and are not responsible for any errors or omissions (negligent or otherwise), regardless of the cause, or for the results obtained from the use of such Content. In no event shall Content Providers be liable for any damages, costs, expenses, legal fees, or losses (including lost income or lost profit and opportunity costs) in connection with any use of the Content. A reference to a particular investment or security, a rating or any observation concerning an investment that is part of the Content is not a recommendation to buy, sell or hold such investment or security, does not address the suitability of an investment or security and should not be relied on as investment advice. Credit ratings are statements of opinions and are not statements of fact.”

WINNING

DETERMINING WINNERS

This Competition is a challenge of skill and the final results are determined by the judges, subject to compliance with these Competition Rules.

Prize awards are subject to verification of eligibility and compliance with these Competition Rules, including satisfaction of the Winners’ Obligations described below. All decisions of the Competition Host will be final and binding on all matters relating to this Competition with no right to appeal. Competition Host may examine the Submission and any associated code or documentation for compliance with these Competition Rules, including but not limited to assessing potential cheating behavior and verifying satisfaction of the Winners’ Obligations described below.

Every Participant agrees to grant and hereby grants to Competition Host an irrevocable, worldwide, and royalty-free right to review the Submission (including any and all submitted source code) for purposes related to evaluation and scoring in this Competition, including but not limited to the assessment of potential cheating behavior and verification of satisfaction of the Winners’ Obligations described below.

In the event that the Submission demonstrates a breach of these Competition Rules, Competition Host may at its discretion take either of the following actions:
  • disqualify your Submission(s); or
  • require that you remediate within one week upon request all issues identified in your Submission(s) (including, without limitation, the resolution of license conflicts, the fulfillment of all obligations required by software licenses, and the removal of any software that violates the software restrictions). Failure to remediate the identified deficiencies within the specified time frame may result in disqualification.
DECLINING PRIZES

A Participant may decline to be nominated as a Winner by notifying Competition Host directly no later than one week following the Competition deadline, in which case the declining Participant forgoes any prize or other features associated with winning the Competition. Competition Host may disqualify a Participant who so declines at Competition Host’s sole discretion if Competition Host deems disqualification appropriate.

WINNERS' OBLIGATIONS

DELIVERY & DOCUMENTATION

As a condition of receipt of the Prize, the Prize winner must deliver the final submission in the form of a Workbench notebook containing any code, models, data analysis and associated documentation to the Competition Host. The delivered software code must be capable of generating the winning Submission and contain a description of resources required to build and/or run the executable code successfully.

After verification of eligibility, each Prize winner may receive the prize from Competition Host or a third party contracted by Competition Host for such purpose, paid in the form of a bank transfer upon receipt of valid Australian bank account details and any other personal information from the intended Prize recipients.  If the payment information provided by a winner is unusable (illegible, incomplete, or erroneous), and/or indicates ineligibility, such winner will be deemed to forfeit the profit. S&P Global and its affiliates cannot be held liable for loss of prize due to error in routing (electronic or by mail), winner’s inability to receive the prize, or inability to contact the winner. Allow 30 days from final confirmation for Prize delivery. Prize winners are responsible for any taxes, fees or other liability resulting from their receipt of a Prize. 

Potential winners will be disqualified and the prize may be awarded to an alternate winner if
  • the required documentation (including bank account details) is not returned within seven days after receipt of any request to provide documentation;
  • prize notification email or prize is returned as undeliverable; or
  • potential winner or winning Team member is disqualified for any reason.
By accepting any Prize, each Participant receiving a Prize thereby agrees to use of his/her name, address, likeness (the provisions above relating to use of Photos of Participants shall apply as appropriate) and/or prize information by Competition Host for promotional purposes in any medium without additional compensation, unless prohibited by law.

RECEIVING PRIZES

If a Team wins a monetary Prize, the Prize money will be allocated in even shares between the registered Team members unless the Team unanimously contacts Competition Host via the email addresses provided on the Competition Website within three (3) business days following the Submission deadline to request an alternative prize distribution.

WARRANTIES AND OBLIGATIONS

PARTICIPANT WARRANTIES AND OBLIGATIONS

By registering, you agree that (a) your all information provided in connection with this Competition (“Your Information”) is complete, correct and accurate and (b) your registration may be rejected or terminated and all Submissions submitted by you and/or your Team may be disqualified if any of Your Information is (or Competition Host has reasonable grounds to believe it is) incomplete, incorrect or inaccurate. You are solely responsible for your providing Your Information.

Void where prohibited or restricted by law. You are responsible for all taxes and reporting related to any award that you may receive as part of the Competition and receipt of any award. You are responsible for abiding by your employer's policies regarding participation in the Competition. Competition Host disclaims any and all liability or responsibility for disputes arising between you and your employer related to this Competition and any such dispute may lead to Participant’s disqualification.

Each Participant is solely responsible for all equipment, including but not necessarily limited to a computer and internet connection necessary to access the Website and to develop and send any and all Submission, and any telephone, data, hosting or other service fees associated with such access, as well as all costs incurred by or on behalf of the Participant in participating in the Competition.

By entering a Submission, you represent and warrant that all information you enter on the Website is true and complete to the best of your knowledge, that you have the right and authority to make the Submission (including with respect to the inclusion of any underlying code and model within the Submission) on your own behalf or on behalf of the persons and entities that you specify within the Submission, including the unrestricted right to grant the license contemplated herein to Competition Host, and that your Submission:
  • is your own original work, or is used by permission in which case full and proper credit and identify is given and the third party contributions are clearly identified within your Submission;
  • does not contain confidential information or trade secrets and is not the subject of a registered patent or pending patent application;
  • does not violate or infringe upon the patent rights, industrial design rights, copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity;
  • is not and does not contain nor is based on material, non-public information;
  • does not contain malicious code, such as viruses, timebombs, cancelbots, worms, Trojan horses or other potentially harmful programs or other material or information and free from any “self-help” code or other disabling code;
  • does not and will not violate any applicable law, statute, ordinance, rule or regulation;
  • does not trigger any reporting or royalty obligation to any third party; and
  • was not previously published and has not won any other prize/award.
A breach of any of these warranties will result in the corresponding Submission being invalid in addition to any other remedies available to Competition Host.

LIMITATION OF LIABILITY

By participating in the Competition, each Participant agrees to release, indemnify and hold harmless Competition Host, their respective affiliates, subsidiaries, advertising and promotions agencies, as applicable, and each of their respective agents, representatives, officers, directors, shareholders, and employees from and against any injuries, losses, damages, claims, actions and any liability of any kind resulting from or arising out of your participation in or association with the Competition, any breach by you of these Competition Terms & Conditions and/or your use of the Data.. Competition Host is not responsible for any miscommunications such as technical failures related to computer, telephone, cable, and unavailable network or server connections, related technical failures, or other failures related to hardware, software or virus, or incomplete, late or misdirected Submissions. Competition Host reserves the right to cancel, modify or suspend the Competition should any computer virus, bug or other technical difficulty or other causes beyond the control of Competition Host corrupt the administration, security or proper play of the Competition, and to determine winners from among Submission not affected by the corruption, if any, in its sole discretion.

Competition Host is not responsible for (a) late, lost, stolen, damaged, garbled, incomplete, incorrect or misdirected Submissions or other communications, (b) errors, omissions, interruptions, deletions, defects, or delays in operations or transmission of information, in each case whether arising by way of technical or other failures or malfunctions of computer hardware, software, communications devices, or transmission lines, or (c) data corruption, theft, destruction, unauthorized access to or alteration of Submission materials, loss or otherwise. Competition Host is not responsible for electronic communications or emails which are undeliverable as a result of any form of active or passive filtering of any kind, or insufficient space in any email account to receive email messages. Competition Host disclaims any liability for damage to any computer system resulting from participation in, or accessing or downloading information in connection with, the Competition.

RESERVATION OF RIGHTS

Competition Host reserves the right to modify the Start Date, End Date, and the right to modify, add or remove additional Competition deadlines for any reason. Any changes will be communicated through the Competition Website. Competition Host also reserves the right to modify, remove or add Data to the Website upon notice via the Competition Website. COMPETITION HOST IS NOT RESPONSIBLE FOR ANY FAILURE OF A PARTICIPANT TO RECEIVE DATA CHANGES.

MISCELLANEOUS

SEVERABILITY

The invalidity or unenforceability of any provision of these Competition Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Competition Rules shall otherwise remain in effect and be construed in accordance with their terms as if the invalid or illegal provision was not contained herein.

This Agreement is governed by and to be construed in accordance with the laws in force in Victoria, Australia.  Each party irrevocably and unconditionally submits to the non-exclusive jurisdiction of the courts of Victoria, Australia and courts of appeal from them.
